1. Eligibility: The InsideOut Dream Draw (the “InsideOut Home and Patio Dream Draw” or “Dream Draw”) is open only to legal Ontario residents, currently residing in Ontario, who are 19 years old and over at the time of entry. Employees, representatives and agents of InsideOut Home and Patio Inc. (“Sponsor”), and its affiliates, and advertising and promotion agencies, as well as the immediate family members (spouse, children, parents and siblings) and those living in the same household of such employees, representatives and agents are not eligible to enter. Void where prohibited by law.
2. Prize Draws: Three (3) Prizes available to be won during each of the two (2) draw dates set out below (each a “Draw Date”). At each draw date a random drawing from all eligible entries received during the Draw Period corresponding with that Draw Date (see below) will be held. The first entrant whose entry form is drawn on the Draw Date and who otherwise complies with these Official Rules will be eligible to win a Prize. The chance of being selected will depend on the number of eligible entries received during the Draw Period corresponding to the relevant Draw Date.
3. Prize and Approximate Value: At the outset of the Dream Draw, there are a total of six (6) prizes available to be won. Three (3) prize will be awarded for each Draw Period. The Draw Period ending August 1, 2010 is for a Tenerife Resort Lounge worth CDN$1399. There is a limit of one (1) prize per person during the Draw Period. The Tenerife Resort Lounge will be delivered to confirmed winners. Transfer of prizes is permitted but limited to merchandise of CDN$1399 undiscounted full retail value.
4. How to Enter: By store - Visit a participating location (Toronto, Richmond Hill, Burlington, Woodbridge, Newmarket, Barrie, and Oakville) during regular store hours between July 7, 2010 and August 1, 2010, (“Draw Period”) and indicate that you would like to donate to Make-A-Wish® Canada (total purchase of $500 or more) and provide the information at the computer kiosk located in the store. To be eligible for the drawing during the Draw Period, entrant must enter at the computer kiosk located in the store by closing time on the last day of the applicable date in the Draw Period of entry that the store is open for business. Upon submission of your entry at the store, you will be automatically entered in the Dream Draw for the Draw Period in which your entry is received, subject to the qualification in the preceding sentence.
Online: Visit us at www.insideoutpatio.ca/dream-online-entry and enter the required information. To be eligible for the drawing in any particular month during the Draw Period, entrant must complete entry before 7:00 PM EST on the last day of the applicable month of entry. Upon submission of your entry online, you will be automatically entered in the Dream Draw for the Draw Period in which your entry is received, subject to the qualification in the preceding sentence.
In the event of a dispute over the identity of a potential winner, the potential winner may be required to provide identification sufficient to show that he/she is the person identified on the entry submission and is otherwise eligible to win.
Limit one (1) entry per person/e-mail address per draw. If more than one entry is received per person/e-mail address per draw, all such entries submitted will be disqualified. All eligible entries received at participating locations in a given month or online will be combined for that month’s drawing.
5. Personal information: Personal information gathered by Sponsor will be used for the purposes of administering the Dream Draw, contacting potential winners and as otherwise permitted or required by law. Please see InsideOut Home and Patio’s Privacy Policy for information on its policy toward maintaining the privacy and security of your information.
The Dream Draw is subject to all federal, provincial and municipal laws. The Dream Draw and the Official Rules will be exclusively governed and construed in accordance with the laws of the province of Ontario. Any dispute arising hereunder shall be governed by the laws of Ontario and shall be adjudicated in the applicable court in Toronto, Ontario.

6. Confirmation of Potential Winners: Sponsor will make reasonable efforts to contact potential winners by telephone and/or email within ten (10) business days following the date of the relevant drawing. If the potential winner cannot be contacted within the time specified above, does not complete the necessary eligibility forms within fourteen (14) days of his/her being informed of his/her name being drawn, does not correctly answer the mathematical skill-testing question, is not otherwise an eligible entrant, or does not otherwise comply with the Official Rules, he/she will not win any prize. In this event, the prize will be awarded to an alternate entrant, who will be selected from among the remaining eligible entries. Any alternate winner will have the same rights and obligations as the original winner. To claim a prize, a potential winner must comply with the Official Rules for the Dream Draw, as well as the Terms and Conditions relating to the use of the InsideOut computer kiosks, must correctly answer unaided a time-limited mathematical skill-testing question administered by Sponsor and must fill out and return a Declaration and Release, including a Publicity Release, within fourteen (14) days of his/her being informed of his/her name being drawn as detailed below.
For a list of winners (identified by name and city/province of residence), send a separate self-addressed envelope, on or after September 4, 2010, to InsideOut Home and Patio Inc., Attn: Dream Draw, 1280 Castlefield Avenue Toronto, Ontario M6B 1G3. All such requests must be received on or before September 30, 2010; requests received after such date will not be processed.
7. Entry Errors/Tampering: InsideOut Home and Patio, Inc. is not responsible for: (i) electronic or digital transmissions or any entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures, destruction or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond InsideOut Home and Patio’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Draw; (iv) any entries submitted in a manner that is not expressly allowed under these rules; (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Draw, (vi) any typographical or other error in the printing or advertising of the offer, administration or execution of the Draw, or in the announcement of prizes/prize winners/finalists; or (vii) malfunctions or interference resulting from illicit, malicious or injurious code (including but not limited to viruses, worms and denial of service attacks). If for any reason the Draw cannot be executed as planned, including but not limited to transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Draw, or if the Draw is compromised or becomes technically corrupted in any way, electronically or otherwise, InsideOut Home and Patio reserves the right to cancel, modify or terminate the Draw and reserve the right, but shall not be obligated, to select the winners from among all non-suspect entries received in each category as of the date/time of such termination/cancellation or modification. InsideOut Home and Patio reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry/voting process or who votes using any automatic or programmed entry duplication method.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR OTHERWISE CORRUPT THE DREAM DRAW OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE DREAM DRAW MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, INSIDEOUT HOME AND PATIO RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Release: By entering this Dream Draw, entrant agrees to release and hold harmless InsideOut Home and Patio Inc., and any promotional partners, each of their parent, subsidiary, affiliate and related companies, and each of its and their respective officers, directors, employees, and agents (collectively the “Released Parties”) from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Dream Draw program, or resulting directly of indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Dream Draw, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
9. Miscellaneous: By participating in the Dream Draw, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and the independent judges, which are final and binding in all respects. No cash substitution is permitted. Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value. Return of any prize notification as non-deliverable or failure to comply with the Official Rules will result in disqualification, and an alternate entrant may be randomly selected in accordance with the Official Rules. All taxes for prizes are the sole responsibility of the individual winners.
By participating, entrants agree: (1) that Sponsor may (unless prohibited by law) use winner’s name, city of residence, photograph, image and/or likeness for advertising and other promotional purposes, without further review or compensation, in any media, in perpetuity and worldwide; and (2) to hold Sponsor, its parent, divisions, affiliates, advertising and promotion agencies and other agents, and their respective directors, officers, employees, representatives, agents and assigns harmless against any and all claims, loss, liability, injury or damage to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of their acceptance, possession or use of a prize or their participation in the Dream Draw.
In the event of a dispute regarding who submitted an entry, the entry will be deemed to have been submitted by the authorized account holder of the email address submitted on the entry form at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet service provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
